Terms of Service

These terms are the agreement between you and Entertaining Ellements (“we”, “us”) for ellementsalign.com, including the Brand New Thoughts Community Scroll, the gallery, the article archive and the community areas. Using the site means you accept them. If you do not, do not use the site.

1. Your account

• You must be at least 13 to hold an account, at least 16 in the UK and EU, and at least 18 to buy anything.
• One person, one account. Keep your sign-in details to yourself; you are responsible for what happens under your account.
• Give us a real email address. It is how we reach you about a purchase or a moderation decision.
• You can close your account at any time by writing to lacedmediacorp@gmail.com.

2. Ments and purchases

Ments are a virtual credit used to pay for on-air submissions. They are a limited licence to use a feature of this site, not money, not a security, and not a cryptocurrency.

• Ments have no cash value, cannot be exchanged for money, and cannot be transferred, sold or given to another account.
• Prices for Ments packs, passes and submissions are set on the site and charged by our payment processor at the price shown at checkout. We can change prices, and a change never applies retroactively to a purchase already made.
• Purchases are final. We do not refund Ments once they are added to your balance, and we do not refund a submission once it has been reviewed. If something goes wrong on our side — you were charged twice, or your submission never reached the broadcast because of a fault of ours — write to us and we will make it right, by credit or by refund.
• Passes grant a stated allowance for a stated period. Unused allowance does not roll over.
• If we close your account for breaking these terms, any remaining Ments are forfeited.
• Payments are handled by Stripe and are also subject to Stripe’s terms. We never see your full card details.

3. What you submit

You keep ownership of everything you submit. By submitting it you grant us a worldwide, non-exclusive, royalty-free licence to display, reproduce, adapt for format, broadcast, stream and archive it in connection with the show and the site, including in recordings, clips and promotional material. This licence continues for material that has already aired, because a broadcast cannot be unmade.

You confirm that:

• The material is yours, or you have permission to use it.
• It does not infringe anyone’s copyright, trademark, privacy or publicity rights.
• Anyone identifiable in a photo has agreed to appear in it on a public broadcast.

Everything is moderated before it airs. A producer may decline any submission, remove it from the scroll, or pull it from the gallery, for any reason or none. A declined submission is a judgement call about the show, not an accusation about you.

4. Rules for the community

Do not submit or post:

• Anything sexual involving minors, or anything that sexualises a real person without consent.
• Threats, harassment, doxxing, or content attacking people for who they are.
• Anything illegal, or instructions for causing real harm.
• Someone else’s work passed off as yours.
• Impersonation of another person or of the show.
• Spam, scams, or unapproved advertising.
• Malware, or anything intended to break the site.

Do not scrape the site, hammer the API, resell access, or attempt to reach data that is not yours. Automated access outside of a published feed needs our written permission.

We can remove content and suspend or close accounts that break these rules. Serious breaches get no warning.

5. Ownership of the site

The name Ellements Align, Brand New Thoughts, Entertaining Ellements, the marks, the design, the software and the articles are ours or our licensors’. You may link to and quote our articles with attribution. You may not republish them whole, or use our marks in a way that suggests we endorse you.

If you believe something here infringes your copyright, write to lacedmediacorp@gmail.com with the work, the URL, and a statement that you are the rights holder or their agent. We remove infringing material promptly.

6. Availability

The site is a live production and can go down, and shows can be rescheduled or cancelled. We do not guarantee uninterrupted service. If a scheduled broadcast does not happen, submissions bought for it carry over to the next one.

7. Disclaimers and liability

The site is provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Articles and broadcasts are commentary and entertainment. They are not legal, financial, medical or professional advice, and you should not treat them as such.

To the fullest extent the law allows, our total liability to you for any claim arising from the site is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.

8. Ending it

You can stop using the site whenever you like. We can suspend or end your access if you break these terms, if we are legally required to, or if we stop running the service. Sections 2, 3, 5, 7 and 9 survive.

9. Law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in California, and both of us consent to that. If any part of these terms is unenforceable, the rest stands.

10. Changes

We can update these terms. The effective date at the top moves when we do, and material changes are announced on the site. Continuing to use the site after a change means you accept it.
